01Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of The Brands List (the “Platform”), operated by The Brands List, a Sole Proprietorship based in Surat, India (“we”, “us”, “our”).

The Platform is built, operated and supported on our behalf by Blackcrest. References to “we” include Blackcrest acting in that capacity.

By creating an account, listing a business, leaving a review, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy, Refund & Cancellation Policy and Service Delivery Policy. If you do not agree, do not use the Platform.

02Eligibility & accounts

• You must be at least 18 years old and able to enter into a binding contract.
• If you register on behalf of a business, you confirm you are authorised to bind that business to these Terms.
• You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at info@thebrandslist.online if you suspect unauthorised use.

03What the Platform provides

The Brands List is a brand-discovery platform. It lets businesses publish a profile and lets visitors discover businesses, read and write reviews, and contact businesses directly.

We are a technology and listings service. We are not a party to any transaction, contract or communication between a visitor and a listed business, and we do not guarantee the quality, safety, legality or availability of any business, product or service listed. Any dealing you have with a listed business is solely between you and that business.

04Business listings & content standards

If you list a business, you represent and warrant that:

• All information you provide is accurate, current and not misleading.
• You hold all rights, licences and registrations required to operate the business and to offer what you list.
• You own or are licensed to use every logo, image, name and description you upload, and they do not infringe anyone’s rights.
• Your listing does not promote anything illegal, and does not include adult content, hate speech, weapons, counterfeit goods, or anything prohibited by applicable law or by Razorpay’s prohibited-business list.

We may review, edit, refuse, suspend or remove any listing or content at our discretion, including for inaccuracy, policy breach, a rights complaint, or non-payment. We aim to give notice and a chance to fix issues where practical.

05Reviews & user content

Reviews must reflect a genuine experience. You may not post fake, incentivised, or competitor-sabotage reviews, or content that is defamatory, abusive, or private to someone else. A business may not review itself or pay for reviews.

You keep ownership of what you post, but grant us a worldwide, royalty-free licence to host, display, reproduce and distribute it on and in connection with the Platform. We moderate reviews for spam and policy breaches and may remove or decline to publish them.

06Plans, billing & payments

Paid plans are billed monthly or annually in advance through our payment processor, Razorpay. Prices are shown in Indian Rupees and are exclusive of applicable taxes (GST is added where applicable).

• Your subscription renews automatically at the end of each billing period until you cancel. You authorise us and Razorpay to charge your selected payment method for each renewal.
• When your first payment succeeds, your listing is published automatically. A GST invoice is issued for every payment and is available in your dashboard.
• You can upgrade, downgrade or cancel from your dashboard at any time. Changes and cancellations are governed by the Refund & Cancellation Policy.
• If a renewal payment fails, we may retry it and may suspend or unpublish your listing until payment is completed.

07Acceptable use

You agree not to:

• scrape, harvest, or bulk-download Platform data except via features we provide;
• probe, scan or test the vulnerability of the Platform, or breach any security or authentication measure;
• upload malware, or use the Platform to send spam or unlawful, infringing or harmful content;
• impersonate any person or business, or misrepresent your affiliation;
• interfere with or place unreasonable load on the Platform or its infrastructure.

08Our intellectual property

The Platform, its design, software, text, graphics and the The Brands List name and logo are owned by The Brands List or its licensors and are protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. No other rights are granted.

09Third-party services

The Platform relies on third-party services including Razorpay (payments), Supabase (hosting and database), Resend (email) and Google Maps (location). Your use of features powered by them may also be subject to their terms. We are not responsible for third-party services or outages outside our control.

10Disclaimers

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that listings or reviews are accurate.

11Limitation of liability

To the maximum extent permitted by law, The Brands List will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the Platform.

Our total aggregate liability for all claims relating to the Platform is limited to the amount you paid us in the three (3) months before the event giving rise to the claim, or ₹5,000, whichever is greater.

12Indemnity

You agree to indemnify and hold harmless The Brands List and its people from any claim, loss or expense (including reasonable legal fees) arising from your listing or content, your use of the Platform, or your breach of these Terms or of any law or third-party right.

13Suspension & termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Platform or other users. On termination, your right to use the Platform ends; sections that by their nature should survive (payment, IP, disclaimers, liability, indemnity, governing law) will survive.

14Governing law & disputes

These Terms are governed by the laws of India. Subject to any right you have to approach a consumer forum, the courts at Surat, Gujarat have exclusive jurisdiction over any dispute arising from these Terms or the Platform.

15Changes to these terms

We may update these Terms from time to time. If a change is material, we will notify registered users by email or an in-app notice. Continued use of the Platform after a change takes effect means you accept the updated Terms.
